駐日オーストラリア大使閣下

 

昨年9月の私たちの要請に応諾いただき、在カンボジア・オーストラリア大使館を通じて貴国政府が「オーストラリア・カンボジア基金：サンライズ・チルドレンズ・ビレッジ」（以下「サンライズ」）の行動に一定の歯止めをかけ、その結果、シェムリアップの件の孤児院の「母親」が強制排除されて子供たちから引き離されるという事態は現時点にいたるまで回避することができました。閣下ならびにオーストラリア政府の迅速な人道的対応に対し、深甚の感謝を表します。

 

しかし遺憾ながら問題は今なお解決を見ておりません。私たちはその後話し合いによる解決を求めてサンライズの事務局長トレバー氏と3回にわたって交渉しましたが、同氏は自らの責任放棄を棚に上げる一方、私たちに新孤児院を設立して50人の子供たち全員を引き取るよう筋違いの要求をするとともに、もしこの要求に沿って「平和的解決」が実現しなければ、近々母親役のトーラエムさんと子供たちは強制的退去となるだろうと宣言しました。カンボジアではそのような行為が法の恣意的適用により適法性の衣をまとうことも可能ですが、サンライズの行為は世界の良識から見れば明白な不正行為であります。孤児院の管理・運営をカンボジア政府から委託されながら、虚偽の口実を並べて子供たちに対する責任を放棄し、自施設の拡張のために子供たちの意思を踏みにじるなど、まともなNGOの行為とは思えません（添付ファイル”injustice and pretext of Sunrise”, “Listen to the voice of the children”を参照）。

 

昨年9月の時点で私たちがオーストラリア大使閣下に助力を求めたことに対し、サンライズ会長コックス氏は怒りを示しながらフンセン首相に事態の解決を依頼すると宣言しました（添付ファイル「correspondence with Ms Cox」を参照; 私自身に関しては、日本大使館が日本の面子にかけて私を保護すると言っているので、国外追放を恐れてはいません）。そして今その言葉通り、来週中にもフンセン首相の側近が社会福祉省の官僚とともにシェムリアップ入りし、警察力を使った強制執行の決定が下されようとしています。もしサンライズが正当なことをしようとしているのであれば、どうして最高権力者の力に訴えたり、オーストラリア大使館の介入に激怒したりするのでしょうか？

 

正義と人権のために、そしてまたオーストラリアという国のよいイメージも保つためにも、オーストラリア政府の再度のご尽力を懇請するしだいであります。すでに世界6カ国で数千人がこの問題への懸念を共有しております。万一子供たちの意思に反して「お母さん」が強制執行により追い出される展開となった場合には、オーストラリアのメディアを通じて御国民の良識に訴えざるをえません（添付ファイル「contribution」参照）。

Responding our request of September 2005 the Australian Government took action through Australian Ambassador to Cambodia to brake questionable activities of “Australia Cambodia Foundation Inc. Sunrise Children’s Village” (noted in the following “Sunrise”). So we could prevent the worst case that the “mother” of the orphanage in Siem Reap/Cambodia gets removed from the property and separated from the children until now. We would like to express our thanks to you and Australian government for your prompt humanitarian action.

However, to our regret, the basic situation hasn’t been changed yet and the problem still remains. We talked in the meanwhile three times with the chairman of Sunrise, Mr. Trevor, and he shifted his responsibility to another person and required us unreasonably to build a new orphanage and take 50 children there. He declared that the “mother” with 50 children will be forced to move out soon if a peaceful solution based on this requirement doesn’t occur before. It’s possible in Cambodia that such an unjust act pretends to be legalized through arbitrary application of law. However it is clear for international common sense that the acts of Sunrise are injustice. In spite of being entrusted by the Cambodian government with the responsibility of controlling and managing of the orphanage, Sunrise has taken no responsibility for the children’s life by telling false pretexts and will trample wishes of the children to extend its own property. This is not an act of reasonable non-government organization (cf. attached file: “injustice and pretext of Sunrise” and “children’s witness”).

 

Because we requested Australian Embassies to help the children last September, Ms Geraldine Cox, the president of Sunrise, got angry and declared us that she would ask the prime minister, Hun Sen, to solve the problem (cf. attached file “correspondence with Geraldine Cox” - as for me, I am not afraid of banishment from Cambodia because Japanese Embassy is supporting me on Japan’s honor). And now in accordance of her words, an aide of Hun Sen will come to Siem Reap with high officials of the ministry of Social Affaire next week to make a final decision maybe for a compulsory eviction. If Sunrise really tries to do justice, we must wonder why they resort to the highest power of Cambodia and why they rage over our request for Australian Embassies.

       

So we would like to ask your help for justice and human rights of the children again. Your help would lead also to keeping good image of Australia. Thousands people in six countries share already serious concern about this issue. If the “mother” should be forced to move out by a compulsory eviction against the wishes of the children, we would have no choice but to send appeal through Australian media to reasonable Australian people (cf. “contribution”)
